Terms of Service – FileRack

Summary: FileRack is a free bookmark-management platform. By creating an account you agree to these terms. Your public profile data can be seen and imported by anyone; keep private information off your public profile.

1. Acceptance of Terms

By accessing or using FileRack ("the Service", "we", "us"), you agree to be bound by these Terms of Service and all applicable laws. If you do not agree, please do not use the Service.

2. Eligibility

You must be at least 13 years old to use FileRack. By registering, you confirm that you meet this requirement. If you are under 18, you must have your parent or guardian's permission.

3. Account Registration & Security

When you create an account you agree to:

Provide accurate, current, and complete information.
Keep your password confidential and not share it with others.
Notify us immediately at support@filerack.com if you suspect unauthorized access to your account.
Be responsible for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these terms.

4. Public Profiles & User-Generated Content

Important: Any information you add to a public profile — including your display name, bio, location, occupation, interests, website URL, and the categories and site bookmarks you mark as public — is visible to every visitor of the site, including guests who are not logged in. This information may be copied, shared, or imported by other users.

Public bookmarks (name and URL only) can be imported by any registered FileRack user into their own account. Importing copies only the site name and URL — no private notes, usernames, passwords, or custom icons are ever shared.
If you set your profile to private, your profile page will be hidden and your display name will appear as Anon_[your account number] (e.g., Anon_3847) in any places where your identity might otherwise appear.
You are solely responsible for deciding what information you make public. Do not place passwords, private credentials, personal financial information, or sensitive personal data in any public-facing field.

By posting content to a public profile, you grant FileRack a non-exclusive, royalty-free licence to display that content as part of the Service.

5. Prohibited Uses

You agree not to use the Service to:

Post illegal, harassing, defamatory, or otherwise objectionable content.
Scrape, crawl, or harvest user data in an automated fashion without our written consent.
Attempt to gain unauthorized access to other users' accounts or any part of the Service.
Upload or link to malware, phishing sites, or other harmful content.
Impersonate any person or organization.
Use the Service for any commercial spam or mass unsolicited messaging.

6. Intellectual Property

The FileRack name, logo, design, and original code are the intellectual property of FileRack and its operators. You retain ownership of any original content you create, subject to the licence granted in Section 4.

7. Third-Party Links

FileRack allows users to save links to third-party websites. We do not endorse or control those sites and are not responsible for their content, privacy practices, or availability.

8. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

9. Limitation of Liability

To the fullest extent permitted by law, FileRack and its operators shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the Service, even if we have been advised of the possibility of such damages.

10. Termination

You may delete your account at any time from your Profile settings. We reserve the right to suspend or delete accounts that violate these terms, with or without notice. Upon termination, your public content may be removed from the Service.

11. Changes to These Terms

We may update these Terms from time to time. We will notify registered users by email or by posting a notice on the site. Continued use of the Service after changes constitute acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the applicable jurisdiction in which FileRack operates. Any disputes shall be resolved through good-faith negotiation; if unresolved, through binding arbitration.

14. Advertising

FileRack is a free service. To support ongoing development and operating costs, we reserve the right to display advertising on any page of the Service, including but not limited to the homepage, dashboard, and public profile pages. Advertising may be added, changed, or removed at any time and without prior notice to users.

Advertisements will be clearly distinguishable from site content wherever practicable.
We will not sell, rent, or share your personal data with advertisers.
Ads may be contextual (based on page content) but will not be targeted using your personal profile information.
